1. Introduction
This Privacy Policy describes how Shimano collects, uses, and shares Personal Information of our customers, prospective employees, visitors to our website at http://fishshop.shimano.com (“Website”) and individuals who contact us to purchase goods and to request information. The Website and our other programs and services are referred to in this Privacy Policy as the “Services.” This Privacy Policy describes how we collect and use Personal Information (information which can be used to identify a specific individual) and anonymous data (which cannot be used to identify a specific individual).

2.1 Personal Information and Sensitive Personal Information
Shimano collects only that Personal Information that is relevant for the purposes for which the data is requested. Shimano does not use your Personal Information in any way that is incompatible with the purposes for which it was collected or for which you have consented.
Some of the categories of Personal Information include “Sensitive Personal Information,” and Shimano may collect and maintain your Sensitive Personal Information, which includes the following (if the information is not publicly available):
• Identifiers: social security number, driver’s license, state identification card, or passport number.
• Other Data: Most data in this category includes sensitive Personal Information, such as health information and data, account log-ins, financial account information, debit or credit card numbers in combination with any required security or access code, password, or credentials allowing access to an account.
• Protected Classes: a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership, or information concerning a consumer’s sex life or sexual orientation.
• Biometric Information: a consumer’s genetic data, or any biometric information processed for the purpose of uniquely identifying a consumer.
• Internet Activity: the contents of a consumer’s mail, email, and text messages, unless Shimano is the intended recipient of the communication.

2.2 Personal Information Collected about Customers
In order to provide our customers with individualized services, we collect certain non-public, Personal Information about you from documents you provide to us. We will only obtain such information from third parties with your express consent and as permitted by law.
2.3 Personal Information Collected about Website Visitors or Callers
We may collect Personal Information from visitors to our Website and others who contact us to request information. In addition, our web server automatically collects and stores the following information from visitors to our Website:

2.4 Cookies, Beacons, Pixels and other Tracking Devices. Our Website uses cookies and pixel tags to collect this information, including Google Analytics cookies.

We may also include web beacons in promotional e-mail messages or newsletters in order to count how many messages have been opened and acted upon. Web beacons are not used to access your Personal Information but they are a technique we use to compile aggregated statistics about usage on the Website. Web beacons collect only a limited range of information including the time and date of page view, cookie number and description of the page on which the web beacon resides.
• Some of our webpages use services provided by Hotjar Ltd. Hotjar provides services including heatmaps, visitor recordings, funnels and form analysis, feedback polls, surveys and recruiters. The information generated by the tracking code and cookie about your use of our Website will be transmitted to and stored by Hotjar on servers in Ireland. • Advertisements appearing on our Website may be delivered to users by us or one of our advertising partners. Our advertising partners may set cookies. 7. SMS Terms and Conditions
If you use a mobile device to access pages of the Website optimized for mobile viewing, opt in to receive SMS (text messages) from Shimano (as/when available), or use a mobile application, the following additional terms and conditions (“Mobile Terms”) also apply to you. Your access to the Website via your mobile device or use of a mobile application confirms your agreement to these Mobile Terms, as well as the rest of the Terms of Use. You agree that you are solely responsible for all message and data charges that apply to use of your mobile device to access the Website or use of a mobile application. All such charges are billed by and payable to your mobile service provider. Not all mobile devices or handsets may be supported, and our messages may not be deliverable in all areas. 8. Protecting children’s privacy
We are strongly committed to protecting the safety and privacy of children who visit our Website. Our Website is not designed nor is it intended to be used by children under 13, and we do not knowingly collect Personal Information online from children under 13 and have adopted techniques to ensure compliance with this Privacy Policy and the Children’s Online Privacy Protection Act of 1998 (“COPPA”). • To request that any inaccurate or incomplete Personal Information maintained by Shimano be corrected or supplemented;
• To request that Shimano limit its use of Sensitive Personal Information to providing you our Services, ensuring the quality, security and integrity of our Services; and
• To request deletion of your Personal Information maintained by Shimano.
All of these rights are subject to certain conditions and exemptions. For example, Shimano will not be obligated to delete your Personal Information if we need to retain it to protect ourselves in the event of a legal claim.

Shimano reserves the right to charge a fee in dealing with such a request as permitted by applicable law and regulations. Shimano is reviewing the applicability and impact of data privacy controls (signals that a web browser can send to a site to limit the collection or use of Personal Information) and will comply with appliable law in the recognition of data privacy controls.
9.2 Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights
California consumers have the right to not be discriminated against because the consumer exercised any of the consumer’s rights under the CCPA. That means that a company may not deny goods or services to the consumer, charge different rates for goods or services, or provide a different level or quality of goods or services if the consumer chooses to exercise their rights under the CCPA (unless the different rate or different level or quality is reasonably related to the value to the business of the consumer’s data). Shimano is required to verify the identity of the individual requesting access to a consumer’s data or requesting deletion of a consumer’s data. To verify your identity, we will rely upon information we have previously collected about you, such as phone calls received from a known phone number or emails received from an known email. We will also rely upon our personal relationship with our customers to verify the identity of a requester.
If the California consumer submitting a request is not a Shimano Customer, such as an individual who requested information through our Website or a phone call to our “contact us” number, then we will verify identify by confirmation using the information we collected, such as phone number of email address.
9.4 Authorized Agent
California consumers may designate an authorized agent to exercise certain CCPA rights on the consumer’s behalf. If a consumer utilizes an authorized agent to exercise a CCPA right that requires verification, the following proof that the agent has been authorized to act on the consumer’s behalf will need to be provided:
• Proof of written permission by the consumer for the authorized agent to act on his or her behalf and separate verification of the consumer; or
• Proof that the authorized agent holds a power of attorney to act on the consumer’s behalf pursuant to Cal. Probate Code §§ 4000-4465.
9.5 Exclusion for Business to Business Information
The rights set forth in this section do not apply to Personal Information reflecting a written or verbal communication or a transaction between Shimano and the consumer, where the consumer is a natural person who is acting as an employee, owner, director, officer, or contractor of a company, partnership, sole proprietorship, nonprofit, or government agency and whose communications or transaction with Shimano occur solely within the context of Shimano conducting due diligence regarding, or providing or receiving a product or service to or from such company, partnership, sole proprietorship, nonprofit or government agency.
10. Policies for Residents of EEA, UK and Switzerland
In addition to the other policies described in this Privacy Policy, residents of the EEA, the UK and Switzerland are afforded the following additional rights and protections as required by the European Union General Data Privacy Regulation (“GDPR”), and UK and Swiss data protection laws. The additional rights and protections set forth in this section of this Privacy Policy apply only to residents of the EEA, the UK and Switzerland. For ease of reference, when we refer to GDPR in this section, we are referring to the UK and Swiss data protection laws, as well as the GDPR. (2) Shimano will acquire personal data by lawful and fair means.
(3) Shimano will utilize personal data upon making clear the purpose of utilization, and will only use the personal data within the scope of the purpose.

(5) Shimano will appropriately manage personal data in order to secure its accuracy, and will also take reasonable safety measures in order to prevent leakage, loss, damage, etc. of personal data.
(6) Shimano will manage personal data appropriately and take reasonable safety measures when personal data is utilized internally within the group or by third parties within the scope of its purpose of utilization or if personal data handling is outsourced.
(7) Shimano will announce the procedures regarding inquiries and requests for disclosure of personal data that Shimano possesses, and will respond promptly and sincerely to such requests. If you accidentally send your inquiry or request to the wrong group company of Shimano, we will take care that such inquired or request will be redirected to the correct group company.

(9) Shimano will continuously revise and improve its personal data management system and structure in order to effectively protect personal data in accordance with future changes in laws or circumstances.
10.2 Definitions
The following additional definitions apply to this Section of the Privacy Policy:
“Processor” means any Person Processing Personal Information.
“Person” means a natural person, corporation, association, organization, partnership, or other legal entity.
“Process” or “Processing” is any activity that involves use of the Personal Information. It includes, without limitation, obtaining, recording or holding the Personal Information, or carrying out any operation or set of operations on the Personal Information including organizing, amending, retrieving, using, disclosing, erasing or destroying it.
